While we make reasonable efforts to provide accurate and timely information about the LLP on the site(s), you should not assume that the information is always up to date or that the site(s) contain all the relevant information available about the LLP.

The preceding applies if the LLP shares your Individual Information collected on this site with other CIBUS DEORUM LLP Brands members. Those separate Privacy Policies will apply if you provide your Individual Information to other CIBUS DEORUM LLP Brands members through their websites.
  • The LLP will not sell, rent, loan, transfer, or otherwise disclose any Individual Information to third parties except as outlined in these Terms and Conditions, along with the Privacy Policy. LLP may share Individual Information with third parties (which do not include affiliated entities or franchisees) under the following circumstances: (i) in connection with a court order, subpoena, government investigation, or when otherwise required by law or to protect any person or entity; (ii) in the event of an actual or contemplated corporate sale, merger, acquisition, or similar event; or (iii) working with third-party companies to support the site’s technical operation or execute a specific promotion or program (such as responding to the guest comments Page, or conduct surveys).

4. WE USE STANDARD SECURITY MEASURES

The LLP, at its sole discretion, may ask for the verification of your account information provided by you, and hence, it is advisable to provide valid information, e.g., mobile number, etc., while creating an account.
  • You can create one account with one mobile number only, and it is not advisable to transfer or interchange such an account with any unknown person. The list of information required to be provided by you, the manner of usage, protection, and confidentiality of your information and Account Information are more specifically dealt with under the Website’s Privacy Policy, and you are requested to read the Privacy Policy in detail before sharing Your information or creating an account.

7. ONLINE SERVICES (ACCESSIBILITY OF GOODS AND SERVICES)

8. HOW DO I CORRECT OR UPDATE MY INDIVIDUAL INFORMATION?

  • According to our policy, PASTACELEBZ does not review suggestions that were not specifically requested. Although we value your interest in PASTACELEBZ, we cannot evaluate suggestions submitted from outside our system at this time. You hereby release PASTACELEBZ and its employees from all claims of any nature arising out of their consideration, use, or development of any product, design, concept, or other materials similar to, or identical to, your submission, whether such consideration, use, or development occurs now or in the future.

  • NEITHER PASTACELEBZ NOR ITS EMPLOYEES WILL BE LIABLE FOR ANY DIRECT OR INDIRECT LOST PROFITS OR LOST BUSINESS DAMAGE, SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES, INCLUDING LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO OR ARISING OUT OF THE ONLINE SERVICES.
  • NOTHING IN THIS SECTION IS INTENDED TO LIMIT PASTACELEBZ’S LIABILITY FOR DAMAGES TO THE EXTENT CAUSED BY PASTACELEBZ’S OWN NEGLIGENCE, GROSS NEGLIGENCE OR INTENTIONAL OR UNLAWFUL MISCONDUCT. ADDITIONALLY, NOTHING IN THIS SECTION IS INTENDED TO LIMIT OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE LIMITED OR ALTERED UNDER APPLICABLE LAWS.   • In addition to other prohibitions as set forth in the PASTACELEBZ Home Delivery Terms and Conditions, you are prohibited from using the channels of site or its content: (i) for any unlawful purpose; (ii) to solicit others to perform or participate in any unlawful acts; (iii) to violate any international, central or state or local regulations, rules or laws; (iv) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (v) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (vi) to submit false or misleading information; (vii) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of Terms and Conditions or of any related Website, other Website/Apps, or the Internet; (viii) to collect or track the individual information of others; (ix) to spam, phish, pharm, pretext, spider, crawl, or scrape; (x) for any obscene or immoral purpose; or (xi) to interfere with or circumvent the security features of PASTACELEBZ Home Delivery Services or any related Website/App, other Website/Apps, or the Internet.

  • We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Terms and Conditions or on any related website/app is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend, or clarify information on the site or PASTACELEBZ Home Delivery Terms and Conditions or on any related website/app, including, without limitation, pricing information, except as required by law.

  • PASTACELEBZ shall not be accountable for any losses incurred as a result of any failure of service, mistake, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure. There is no intent for the site(s) to be used in a Court of law. PASTACELEBZ’s Privacy Policy and Promotional T & C is an integral component and is hereby incorporated by reference. 17. ELIGIBILITY

  • The LLP reserves the right to refuse access to use the services offered at the Application to new users or to terminate access granted to existing users at any time without affording any reasons for doing so.

19. INDEMNIFICATION

  • You agree to indemnify, defend, and hold harmless LLP, its brands, outlets, franchisee/s, affiliate/s, directors, designated partners, partners, members, and any persons, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any cause of action, claim or demand, including attorneys’ fees, made by any third party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

20. SEVERABILITY

  • Suppose any provision of these Terms and Conditions is deemed unlawful, void, or unenforceable. In that case, such provision shall nonetheless be enforceable and permitted by applicable law. The unenforceable portion shall be deemed to be severed from these Terms and Conditions; such determination shall not affect the validity and enforceability of any other remaining provisions whatsoever.

  • The LLP reserves the right to change, alter, and/or modify these Terms of Use or any policy or guideline of the site(s), including the Privacy Policy and Promotional Terms & Conditions, at any time and in its sole discretion.
  • Any changes or modifications will be effective immediately upon posting the revisions to the Site(s), and you waive any right you may have to receive specific notice of such changes or modifications.

1. HOME DELIVERY CHANNELS

  • PASTACELEBZ is running PASTACELEBZ Home Delivery Service (hereinafter referred to as “PASTACELEBZ Home Delivery”) via the following channels (through its franchise partners and its equity-owned stores in India):
  • PASTACELEBZ website viz. https://www.pastacelebz.com/menu and/or
  • PASTACELEBZ mobile site viz. https://www.pastacelebz.com/menu and/or
  • The acceptance of an order shall be at the entire, sole, and absolute discretion of PASTACELEBZ. PASTACELEBZ further reserves the right to refuse to accept or cancel any order from any customer beyond the delivery area without assigning any reasons. It shall be the sole and absolute responsibility of the customer to ensure that delivery instructions are clear and precise.
  • It is clarified that PASTACELEBZ Home Delivery is not available at all PASTACELEBZ restaurants. To check whether it is available in your area, customers need to refer to the information and details disclosed in the respective PASTACELEBZ Home Delivery channels, as revealed above.

2. WITH REGARDS TO THE GOODS OFFERED BY THE WEB SERVICES

  • The valued customers would surely agree that there is no guarantee that the restaurant where you pick up/ (ordered delivery) your order will have the items you ordered in stock. The valued customers might not be able to find a particular product/ingredient in the product at a certain restaurant due to unpredictable seasonal conditions and supply of products/ingredients.
  • Please note that the food and packaging images depicted on these online services are for illustrative purposes only and may differ from what you actually receive when ordering from a restaurant. Colors may look different on your screen than they actually are due to various factors. All food products must be consumed within four hours of purchase.

3. CASHBACK OR DISCOUNT ON THE PAYMENT PAGE

Cashback or Discounts offered on the payment method selection page of PASTACELEBZ are offered by the respective payment method partners/third parties. LLP is not providing these discounts. While we provide the details of the offers and promotions on our portals, please keep yourself updated on the changes and alterations that may be carried out by the respective payment method partners/third parties. Please note that no two offers can be combined.

4. REGARDING THE COST OF YOUR ORDER

PASTACELEBZ sets its own prices and has the right to levy any applicable taxes or charges at any time at its sole discretion. Restaurant menu/ online menu listings for different regions may have different prices. It’s possible that some promotions and prices won’t apply to your order. The liability of PASTACELEBZ for any order placed by the customer is limited to Rs. 500 only.

5. PAYMENT POLICY

  • Payment is an integral part of an online ordering experience.
  • All payments shall be collected through secured payment options. We accept all payment options, such as Credit Cards, Debit Cards, Net Banking, UPI, Cash, etc.
  • All payments for purchases made by you on the site(s) shall only be in Indian Rupees. In case of a prepaid transaction, after payment for the order has been successfully received by the LLP, you will be sent an SMS notification to your registered mobile number provided to the LLP confirming receipt of your order. The LLP reserves the right to withdraw, block, or limit your purchases using Cash on Delivery at any time.

6. CREDIT AND DEBIT CARD

  • The LLP accepts all Visa, Master Card, Maestro, American Express and Diners cards. You will be redirected to your issuing bank’s website, where you must follow the instructions to complete the payment.
  • By Net Banking, you can make payment for an order by using your Net Banking account. The site(s) accepts payments for your orders through your net banking account. You will be redirected to your bank’s website, where you can make payment using your payment process.
  • Cash on Delivery Cash on Delivery may be available for certain areas, and the LLP solely reserves the right to withdraw, block, or limit your purchases using Cash on Delivery at any time.

7. ISSUING BANK TERMS AND CONDITIONS

Users understand and acknowledge that all payments made by the Users using valid credit card/ Debit card/ Cash Card/ and other payment instruments or mechanisms, including net banking facility, will be processed using a payment gateway or appropriate payment system infrastructure, and the same is governed by a separate set of terms and conditions agreed between the User and their respective issuing Bank and payment instrument of the issuing LLP.

8. DELIVERY POLICY

  • The acceptance of an order shall be at the entire discretion of the LLP.
  • It is clarified that delivery is not available at all PASTACELEBZ restaurants. To check whether delivery is available in your area, customers need to:
    • Log on to the website viz. http://www.pastacelebz.com; and/or
    • check the mobile site viz. https://www.pastacelebz.com /; and/or
    • check the mobile applications viz. PASTACELEBZ is available on Android and Apple Store.
  • The LLP reserves the right, in its sole discretion, without limitations, conditions, and/or qualifications, and without the need for prior notification, to limit, change, modify, or cancel any order and/or to refuse any service to any customer for any reason attributable to the unavailability of the items ordered, or other circumstances and conditions beyond the control of the LLP which would render impossible or delay the fulfillment of its obligations.
  • The LLP reserves the right to refuse to accept or cancel any order from any customer beyond the delivery area or otherwise.
  • Delivery orders are subject to:
    • Customer addresses falling in the nearest restaurant’s delivery area (area within which PASTACELEBZ delivery is available). The delivery area is defined from time to time by the LLP at its discretion and is subject to change.
    • The delivery address is mapped to the nearest restaurant that delivers in the customer area.
    • Availability of PASTACELEBZ products and services at the outlet.
    • The valued customers can only place orders from that delivery locality, which is listed on the restaurant map and covers the area where the Delivery is desired. However, you may pick up your order from the nearest PASTACELEBZ restaurant if this service is available at the respective PASTACELEBZ restaurant.
  • Once the order has been placed, it cannot be changed or canceled by the customers for any reason whatsoever, subject to the cancellation policy.
  • The price of the LLP’s products is exclusive of the below charges. The customer is liable to pay delivery charges and restaurant handling charges (on the order placed through the Site(s)) as applicable in that particular city, plus goods and service tax and other taxes as may be applicable from time to time.
  • The LLP’s personnel shall use their best efforts to meet the scheduled delivery time; however, it does not guarantee these delivery timelines in every case. The LLP shall not have any liability to the Customer if the Customer/User’s order fails to meet such scheduled delivery time in whole or in part.
  • It is the customer/user’s responsibility to ensure that the customer/ user, himself/herself, or an appropriate person is available at the delivery address, and he/she must pay in full for the order placed through the Site(s).
  • If the customer/users or appropriate person fails to be present for delivery, the LLP is entitled to charge the customer/ User in full the amount of the order and the cost of delivery at its sole discretion. PASTACELEBZ holds all rights to reject the delivery of an order or to cancel the same owing to any foreseeable and/or unforeseeable reasons that might cause any hindrance in the fulfillment of the same without any obligation to the customer from PASTACELEBZ’s part.

9. LATE NIGHT DELIVERY

  • Late-night delivery is applicable in the selected restaurants of PASTACELEBZ within the territory of India, subject to the local laws and availability of stocks/ riders in the restaurants.
  • Delivery Charges, Restaurant Handling Charges, and other charges shall apply to all delivery orders.
  • Delivery Charges, Restaurant Handling Charges, and other charges will be applicable per invoice/bill in case of multiple delivery orders.
  • Late-night orders can be placed through all PASTACELEBZ digital assets.
  • Advance ordering is not allowed under Late-night delivery ordering.
  • Takeaway is allowed. Dine-in is not allowed under Late-night delivery ordering.
  • PASTACELEBZ reserves the right to modify the late-night delivery terms and conditions (including charges), which will be communicated to the customer on the order’s checkout page.

10. IN-STORE TABLE ORDERING THROUGH QR CODE

Customers can avail of table ordering by scanning the QR code that is present on the tables. Every table has a unique QR code which redirects users to:
  • App store to download the app if the user doesn’t have the app.
  • PASTACELEBZ App if the user has the app.
  • QR codes on tables are unique to PASTACELEBZ and can only be used for in-store ordering. If a QR code scan results in any other website or link redirection, guests should immediately stop the ordering process and contact the store staff. Steps to avail table ordering:
    • Guests are requested to be seated at any table of their choice.
    • The guest needs to open the camera (android) or QR code scanner (iOS).
    • Scan the code.
    • Redirection to the app store- PASTACELEBZ app.
    • Download the app.
    • Browse the Menu.
    • Add your favorites to the cart.
    • Check out using multiple payment options.
    • Order is placed.
    • Hot food will be served at your table.

11. CUSTOMER CANCELLATION OF ORDER AND REFUND

Cancellation of Order

  • As a general rule, you shall not be entitled to cancel an Order once placed. You may choose to cancel the Order only within one minute (i.e., 60 seconds) of the Order being placed. Once the customer has placed the order successfully, the customer cannot change or cancel it for any reason. You may get an update on the order status by calling the restaurant directly.
  • The staff and PASTACELEBZ system automatically begin the preparation of the order once it is received. Hence, the order cannot be canceled or modified once it is placed after 60 seconds.

REFUND

  • You may be entitled to a refund for prepaid Orders. You shall also be entitled to a refund of proportionate value in the event the packaging of an item in an Order or the complete Order is either tampered with or damaged, and you refuse to accept the Order at the time of delivery for the said reason.
  • You may be entitled to a refund of up to 100% of the Order value if the LLP fails to deliver the Order. Such incidences will be assessed by the LLP on a case-to-case basis.
  • The LLP decision on refunds shall be final and binding.
  • All refund amounts shall be credited to your account as may be stipulated as per the payment mechanism of your choice; the estimated timelines are detailed below:

  • PASTACELEBZ shall use its best efforts to meet the scheduled delivery time. At times, the delivery schedule may also be conveyed to the customer by the PASTACELEBZ Home Delivery Call Center on the phone. However, it does not guarantee that the delivery timelines will be met in every case.
  • LLP OR PASTACELEBZ shall not have any liability to the customer if the customer’s order fails to meet such scheduled delivery time in whole or in part.
  • It is the customer’s responsibility to ensure that the customer or an appropriate person is available at the delivery address, and they must pay in full for the order placed through PASTACELEBZ Home Delivery channels. Suppose a customer or other person fails to be present for PASTACELEBZ Home Delivery, in that case, PASTACELEBZ is entitled to charge the customer in full the amount of the order, the cost of Delivery, and any other charges that may be levied from time to time for the PASTACELEBZ Home Delivery.
  • PASTACELEBZ reserves the right to reject or cancel the delivery order even after acceptance.
  • In case of a customer ordering through PASTACELEBZ Home Delivery Call Center, PASTACELEBZ is unable to contact the customer due to any reason whatsoever on the mobile/landline number of the customer as provided by the customer at the time of placing the order or in case of non-receipt of payment in whole or in part in any previous order or the current order or
    • In case of abuse to any employee/ representative /riders of PASTACELEBZ or its delivery partners in any previous incident or
    • If there is a trend of order cancellations or
    • If there is a trend of frequent frivolous complaints and consequent replacements or
    • If the customer has provided the wrong, inaccurate, incomplete, or incorrect address or
    • If the customer’s address does not fall in the defined delivery area of the nearest or any other restaurant or beyond the delivery area of PASTACELEBZ or
    • Given difficult operating conditions for PASTACELEBZ Home Delivery like heavy traffic or bad weather conditions or New Year’s Eve, during festivals like Holi, Ganesh Chaturthi, Christmas, Diwali, and Navratri, etc., or in instances of political rallies, processions, etc.;
In all the above-mentioned or related events of similar nature, then PASTACELEBZ reserves the absolute right, in its sole and absolute discretion, without limitations, conditions, and qualifications, and without the need for prior notification, to limit, change, modify, or cancel any order and to refuse any service to any customer for any reason attributable to circumstances and conditions beyond the control of PASTACELEBZ which would render order fulfillment impossible or delay the fulfillment of its obligations at its sole discretion, without the need to assign any reason or explanation of any kind to anyone.

12. CHANGE OF MENU AND PRICING

We request that the customers note that the menu and prices are subject to change without notice. Therefore, the customers are responsible for keeping themselves informed of such updates and checking the items in the cart before placing the order for PASTACELEBZ in dining or Home Delivery.

13. PRICING AND PAYMENT

  • The price of PASTACELEBZ products in all states where PASTACELEBZ operates its restaurants is exclusive of the Goods and Services Tax (GST) at applicable rates.
  • The price of PASTACELEBZ products and services is exclusive of ‘Restaurant Handling’ charges. The customer is liable to pay Restaurant Handling charges (on orders placed through PASTACELEBZ Home Delivery) as applicable in that area.
  • Upon Delivery, the customer shall pay in cash all charges, including but not limited to Restaurant Handling charges mentioned above, incurred in connection with the order. Alternately, while placing the order on the eligible PASTACELEBZ Home Delivery Service channels, customers may choose the online payment option, upon which they shall be redirected to an external payment gateway, on which they are required to follow the payment gateway’s separate instructions for effecting online payment. The payment gateway is not under PASTACELEBZ’s purview, control, or discretion. PASTACELEBZ is not responsible for and shall not be liable to any extent or in any manner for any payment-related or internet-related issues customers face about online payments, including payment refunds. Customers shall indemnify and keep PASTACELEBZ and its affiliates fully and effectively indemnified.
  • In case the order that is paid through the digital payment method is canceled due to the non-availability of the ordered product at the restaurant or any unforeseen circumstance that renders the order fulfillment impossible on the part of PASTACELEBZ or the restaurant, the amount will be returned by reversing the transaction by PASTACELEBZ restaurant. This refund will be returned to the source within 5 to 7 working days. However, PASTACELEBZ is not responsible for any delay on the bank’s or third-party payment gateway’s side.

14. REGISTRATION WITH PASTACELEBZ

  • PASTACELEBZ reserves the right to send to the customers registered with PASTACELEBZ Home Delivery Short Message Service (SMS) regarding the order placed, even though the mobile numbers of such customers are registered with the DND (Do Not Disturb) services. However, customers can unsubscribe to avoid receiving promotional electronic mail.
  • Registering for PASTACELEBZ Home Delivery allows PASTACELEBZ to contact you for offers and updates on your account.
  • Further information on how we use your individual information when using our Internet ordering system:
    • Additional information is collected when you order online using the online services to avail yourself of PASTACELEBZ Home Delivery. This information assists in the Delivery to your door and verification of your credentials. The Internet order system also stores information about your order to help you remember and re-order the same menu in the future.
    • Credit card, debit card, and other payment gateways or mechanisms, including net banking details: PASTACELEBZ does not store any of your credit card, debit card, cash card, or other mechanisms, including net banking details. We work with third-party secured payment providers to handle online transactions that might store card information based on the user’s consent.

15. TERMS AND CONDITIONS FOR ALL OFFERS (COUPONS, DEALS AND BUNDLES)

  • Terms and Conditions for all Offers (Coupons, Deals, and Bundles): by accepting to avail of the offer, it is deemed that the user has agreed to all the terms and conditions of the offer. Offers cannot be clubbed with any other offer/scheme being run by the LLP. All listed prices are exclusive of taxes.
  • Only one offer is valid per order/ transaction. All offers have limited validity. LLP offers cannot be redeemed for cash or exchanged with any other product.
  • Offers are valid only in participating restaurants. Customers may kindly note that no two offers can be combined. PASTACELEBZ reserves the right to accept or reject any offer without any prior notice. It is mandatory to punch in the coupon before placing the order for its redemption.

16. CHANGE OF TERMS AND CONDITIONS

  • PASTACELEBZ may change the terms of, or add new terms to, these Terms and Conditions for PASTACELEBZ Home Delivery (“PASTACELEBZ Home Delivery Terms and Conditions”) at any time, with or without cause, and without giving notice.
  • These PASTACELEBZ Home Delivery Terms and Conditions have to be read in conjunction with our Privacy Policy, General Terms of Use, Disclaimer, offers related terms and conditions, and any other terms and conditions as available on the PASTACELEBZ website and that may be amended by CIBUS DEORUM from time to time. Therefore, the customers are responsible for informing themselves of such updates.

17. (PASTACELEBZ) TRADEMARKS AND COPYRIGHTS

  • Unless otherwise indicated, the site(s) and all content and other materials therein, including without limitation to all trademarks, logos, and service marks displayed on the site(s), are registered and unregistered Trademarks of PASTACELEBZ and/or third parties (including the LLP) who have authorized their use (collectively the “Trademarks”).
  • All trademarks, designs, text, graphics, pictures, information, data, software, sound files, other files, and the selection and arrangement thereof (collectively, “Site Materials”) are the proprietary mark of the LLP or its licensors or users and are protected by Indian and/ or international trademark and copyright laws. The IPR relating to PASTACELEBZ is owned by Cibus Deorum LLP.
  • You shall not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Trademarks in any way. The use of PASTACELEBZ’s Trademarks on any other website is strictly prohibited. All of the materials contained on the site(s) are copyrighted except where explicitly noted otherwise.
  • PASTACELEBZ will aggressively enforce its intellectual property rights to the fullest extent of the law, including seeking criminal prosecution. PASTACELEBZ and or the LLP neither warrants nor represents that your use of materials displayed on the Site(s) will not infringe the rights of third parties not owned by or affiliated with PASTACELEBZ.

18. USE OF ANY SITE MATERIALS IS AT YOUR OWN RISK

  • Further, the site materials will be used only for personal, informational, and ordering purposes. Such license is subject to the Terms of Use and does not include: 
    • any resale or commercial use of the Site(s) or Site Materials;
    • the collection and use of any product listings, pictures, or descriptions;
    • the distribution, public performance, or public display of any Site Materials;
    • modifying or otherwise making any derivative uses of the Site(s) and the Site Materials, or any portion thereof;
    • use of any data mining, robots, or similar data gathering or extraction methods;
    • downloading (other than the page caching) of any portion of the Site(s), the Site Materials, or any information contained therein, except as expressly permitted on the Site(s); or

Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring in any manner, whether by implication, estoppel, or otherwise, any title or ownership of, or exclusive use-rights to, any intellectual property or other right and any goodwill associated therewith.

19. RESTRICTIONS ON USE

  • The Site(s) may include interactive areas in which you or other registered users may create, post, send, or store messages, materials, data, information, text, music, sound, photos, video, graphics, applications, tags, code, links or other items or materials on the Site(s) (“User Content”). By using the Site(s), you agree not to post, upload, transmit, distribute, store, create, or otherwise publish through the Site(s) any of the following:
    • Unless specifically requested by LLP, any “sensitive” personally identifiable information about yourself or another person (including, but not limited to, information that relates to health or medical conditions including physical, physiological and mental health conditions, passwords, social security numbers, biometric information, credit cards, debit cards, other payment instruments, bank accounts or other financial information, other information concerning trade union membership, sex life, sexual orientation, political opinions, criminal charges or convictions, religious beliefs, racial or ethnic origin, or other sensitive matters);
    • User Content that is unlawful, blasphemous, paedophilic, racially or ethnically objectionable, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, otherwise objectionable or which threatens our relationships with our employees, partners, customers, suppliers or licensors, relates to or encourages money laundering, gambling or otherwise unlawful in any manner;
    • User content that may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party. By posting any User Content, you represent and warrant that you have the lawful right to distribute and produce such User Content;
    • User Content that impersonates any person or entity or otherwise misrepresents your identity or affiliation with another person or entity;
    • Spam, direct marketing communications, or any unsolicited advertising, promotional materials, or other forms of solicitation or commercial content;
    • User Content that constitutes, encourages, or provides instructions for a criminal offense, violates the rights of any party, or creates liability or violates any applicable local, state, national, or international law;
    • Software viruses, spyware, Trojan horses, easter eggs, or any other destructive files, computer codes, or programs designed to interrupt, destroy, or limit the functionality of any computer resource;
    • User Content that, in the sole judgment of the LLP, is objectionable, restricts, or inhibits any other person from using or enjoying the Site(s) or which damages the image or rights of the LLP, other users, or third parties;
    • User Content that belongs to another person and to which the user does not have any right;
    • User Content that harms minors in any way;
    • User Content which deceives or misleads the addressee about the origin of the messages or communicates any information that is grossly offensive or menacing in nature; and
    • User Content that threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order, causes incitement to the commission of any cognizable offense, prevents investigation of any offense, or is insulting to any other nation.
  • The LLP does not control, take responsibility for, or assume liability for any User Content posted, stored, or uploaded by you or any third party or for any loss or damage thereto, nor is the LLP liable for any user conduct or any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. The interactive areas are generally designed as open and public community areas for connecting and sharing with others. When you participate in these areas, you understand that certain information and content you choose to post may be displayed publicly. You are solely responsible for using the Site(s) and agree to use the interactive areas at your own risk.
  • If you become aware of User Content that you believe violates these Terms of Use, you may report it by clicking on the “Report Abuse” or “Flag” links located just below each piece of User Content. 20. THIRD-PARTY LINKS

You agree that we shall not be responsible or liable in any way for any loss or damages of any sort incurred as the result of any such dealings with any third parties.

21. SEVERABILITY

If any provision of these Terms of Use shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

22. DISPUTE RESOLUTION

  • The PASTACELEBZ staff is trained, and its system is configured to minimize disputes. In the unlikely event of a dispute, PASTACELEBZ would endeavor to resolve the same amicably. In case of failure to reach a dispute resolution, PASTACELEBZ’s decision shall be final and binding on all concerned. Disputes, if any, are subject to the jurisdiction of the competent court/s at Delhi only.

23. ADHERENCE AND ACCEPTANCE OF TERMS AND CONDITIONS

It is clarified that by placing an order through any channels for availing the PASTACELEBZ Home Delivery, in-store dining, or takeaway, a customer unconditionally and fully accepts all above terms and conditions of PASTACELEBZ Home Delivery, read with the Privacy Policy and other covenants of the Terms and Conditions provided herein on the site.
